Open Work Permit ⇒

Open work permits are divided into two categories:

  • unrestricted (allowing foreign nationals to serve in any profession and location)
  • restricted (allowing foreign nationals to work only in certain occupations and locations) (restricting the occupation or the location)

The following are examples of open job permits:

  • occupational limits, based on the personal condition of the candidate
  • location limitations, depending on the category (such as a bridging open work permit under the provincial nominee class).

You may be eligible for an open work permit if you

  • have an employer-specific work permit and are being violated or at risk of being exploited in relation to your job in Canada
  • are a foreign student who graduated from a recognised learning institution and are eligible for the Post-Graduation Work Permit Program
  • are a student who is no longer able to cover the costs of your studies (Destitute Student).
  • applied for permanent residence in Canada (Bridging Open Work Permit)
  • are a refugee, refugee claimant, protected person, or their family member
  • are the spouse or common-law partner of a qualified worker or foreign student
  • are the spouse or common-law partner of an Atlantic Immigration Pilot Program candidate
  • are a temporary resident permit holder
  • are a young worker participating in special programs.

You must meet additional criteria to be eligible in each of these situations.

Post Graduate Work Permit ⇒

Students who have graduated from qualifying Canadian designated learning institutions (DLIs) can apply for an open work permit to receive useful Canadian work experience via the Post-Graduation Work Permit Program (PGWPP). Through the PGWPP, graduates may obtain skilled Canadian work experience in National Occupational Classification (NOC) competence form 0 or skill category A or B, which lets them apply for permanent residency in Canada through the Canadian Experience Class(CEC) under Express Entry.

To be eligible for a post-graduation work visa, the claimant must have temporary status or have already left Canada. They must have earned a diploma from a recognized educational institution (DLI). They may also have proof that they satisfy any of the following requirements:

  • They have completed an undergraduate, technical, or advanced training program of at least 8 months length at a qualifying institution in Canada that leads to a degree, diploma, or certificate.
  • They must have retained full-time student status in Canada during each academic session of the program or programs of study they have completed and applied as part of their post-graduation Work permit application.
  • They also submitted a transcript and an official letter from the qualifying DLI stating that they have completed their program of study and have fulfilled the criteria.

LMIA based WP ⇒

A Labour Market Impact (LMIA) is a document that a Canadian business may need to hire a foreign worker.

A positive LMIA indicates that a foreign worker is required to fill the position. It will also reveal that there is no Canadian worker or permanent resident who is qualified for the position. A confirmation letter is the name given to a positive LMIA. If an LMIA is required, the employer must apply for one.

The worker can apply for a work permit after the LMIA is received by the company.

A worker will require the following documents to apply for a work permit:

  • a job offer letter
  • a contract
  • a copy of the LMIA
  • the LMIA number

Study Permit

The Study permit is a document that requires foreign nationals to study in Canada at DLIs (Designated Learning Institutions). To study in Canada, most foreign nationals need a study permit.

A Study permit normally lasts for the duration of your program plus an additional 90 days. You have 90 days to plan to leave Canada or to apply for an extension.

You can study in Canada if you:

⇒  are registered in a specified learning institution (DLI);
⇒  can demonstrate that you have sufficient funds to pay for your:

  • tuition fees
  • living costs for yourself and any family members accompanying you to Canada
  • return transportation for yourself and any accompanying family members to Canada

⇒  follow the rules, maintain a clean criminal record, and obtain a police certificate (if required)
⇒  are in good condition and had a physical examination (if required)
⇒  show an officer that you will leave Canada after your study permit expires

Extensions

Work permit: If you have a work permit that is about to expire or that you need to change, you must apply to extend it or change the conditions on it.

You should apply to extend your work permit at least 30 days before your current permit expires.

Visitor Visa: if you are on a visitor visa and you need to extend your stay in Canada then you can apply to extend your visa at least 30 days before your current permit expires.

A visitor record is for people who want to

⇒ extend their stay in Canada as a visitor, or
⇒ change their permit type from

  • a study permit to a visitor record
  • a work permit to a visitor record

It does not matter if you entered Canada using a visitor visa, electronic travel authorization (eTA) or another document. If you want to extend your stay in Canada as a visitor, you need a visitor record.

Working holiday visa / International Experience Canada (IEC)

International Experience Canada gives an opportunity to work and explore Canada simultaneously. You can work in Canada while travelling. There are three types of visa classes in this.

Working holiday: This category is for you if you:

  • Do not have a job offer yet. (due to current travel restrictions, a valid job offer is required)
  • Want to work for more than one employer in Canada.
  • Want to work in more than one location.
  • would like to earn some money so that you can travel.

The type of work permit you get for Working Holiday is an open work permit.

Young professional: You can gain Canadian professional work experience to better compete in a global economy. This category is for you if you:

  • Have a job offer in Canada that contributes to your professional development.
  • Will work for the same employer in the same location during your stay in Canada. Under this category, work must be:
  • paid
  • not self-employed

The type of work permit you get in the Young Professionals category is an employer-specific work permit.

International Co-op: You can get valuable overseas work experience related to your field of study. This category is for you if you:

  • Are a student registered at a post-secondary institution.
  • Have a job offer for a work placement or internship in Canada.
  • Need to do this work placement or internship to complete your studies.
  • Will work for the same employer in the same location during your stay in Canada.

The type of work permit you get in the International Co-op (Internship) category is an employer-specific work permit. The internship you are offered in Canada must be directly linked to your field of studies.
